Preliminary note
Alpstay.kross.travel is the booking portal for vacation accommodations of Fewo Service Südtirol GmbH. Fewo Service Südtirol acts as landlord, agent and service provider depending on the accommodation. A booking initiated by the guest and accepted by Fewo Service Südtirol constitutes a rental contract for tourist purposes between the two parties.
Scope of application
The General Terms and Conditions (GTC) apply to the rental contract between the guest and Fewo Service Südtirol.
The subletting or reletting of the provided accommodation, as well as its use for purposes other than accommodation, require the prior written consent of Fewo Service Südtirol.
Terms and conditions of the guest are only applicable if this has been agreed upon in advance.
Agreement
The contract is concluded by two concurring written declarations of intent, by offer and acceptance.
Contractual partners are Fewo Service Südtirol and the guest. If a third party has ordered for the guest, he is liable to Fewo Service Südtirol.
Fewo Service Südtirol is liable for its obligations arising from the contract.
The period of limitation for all claims of the guest is 6 months.
Services
Fewo Service Südtirol is obliged to keep the accommodation booked by the guest ready and to provide the agreed services. Should Fewo Service Südtirol not be able to provide the booked accommodation due to unforeseen events or force majeure, it shall endeavor to offer the guest alternative accommodation and inform the guest of this without delay.
The guest is obligated to pay the prices of Fewo Service Südtirol that are valid or agreed upon for the provision of the accommodation and the other services used by the guest.
The agreed prices include the respective legal value added tax.
Arrival and departure
Arrival is usually possible from 3 pm. The guest can take the key from a key box near the accommodation. The current code to the key box will be communicated to the guest shortly before arrival, provided that he has sent Fewo Service Südtirol the booking-relevant data.
The departure must take place until 10 o'clock. The guest leaves one key in the accommodation and closes the doors behind him, the guest puts the second key back in the key box.
If the guest does not leave the accommodation by 10 a.m. without prior agreement, Fewo Service Südtirol reserves the right to claim the rent for the following day, even if the guest leaves on the same day.
Booking and payment
After booking an accommodation through Alpstay, the guest will receive a reservation confirmation via e-mail.
The guest must pay a deposit of 35% of the total amount (or the full total amount, in case his arrival is within 14 days after booking).
The payment can be made by:
Bank transfer: the reservation confirmation will contain the request for the deposit of 35% of the total amount and the bank details. It is requested to make the deposit by bank transfer within 3 days. If no money is received within 7 days of the booking, the reservation will be automatically cancelled under the conditions indicated.
Paypal / Stripe (Master, VISA, American Express): the reservation confirmation will contain the confirmation of the deposit for 35% of the total amount.
As soon as the deposit has been received on the account of Fewo Service Südtirol, the guest will receive a booking confirmation via e-mail, with the request to send a copy of his, as well as all fellow travelers, passport or identity card, as well as the cell phone number under which the guest can be reached during his stay.
Local tax
The municipalities of South Tyrol charge a local tax per guest over the age of 14 per night. The amount of the local tax varies depending on the municipality.
This tax is to be paid by the guest to Fewo Service Südtirol, which then passes it on to the municipality on behalf of the accommodation provider. The local tax is exempt from VAT. Residents of the municipality are exempt from the local tax (we kindly ask you to send us a proof of residency).
Cancellation conditions
Up to 30 days before arrival: cancellation free of charge
14-29 days before arrival: 50 % of the total sum
0-14 days before arrival or no-show: 100% of the total amount of the stay
The final cleaning fee will not be charged in case of cancellation.
Any cancellation by the guest must be communicated in writing and requires the written confirmation of Fewo Service Südtirol. If the cancellation is made up to 30 days before arrival, all deposits already made will be refunded to the guest.
Complaints
Complaints are to be addressed immediately by the guest to Fewo Service Südtirol (by telephone or by mail). Fewo Service Südtirol will follow up the complaint as soon as possible, but at the latest within 24h, and if possible will solve the problem within this period of time. After that the guest is entitled to a reduction of the rent. In case of delayed complaint the claim for cancellation and reduction will be forfeited.
Loss of a key
The loss of a key must be reported immediately to Fewo Service Südtirol.
Every single lost key costs 50 €. Bringing a spare key costs 20 € until 8 pm, after that 50 €.
If a tenant locks himself out of the accommodation, he is not allowed to hire a key service on his own authority. He must first contact Fewo Service Südtirol. Possible costs for opening and repairing the door are to be paid by the guest.
Smoking
Smoking in the apartment and in the staircase is strictly forbidden. If available, the guest may smoke on the balcony or terrace, otherwise outside the building, e.g. in the courtyard. In case of violation of this rule, Fewo Service Südtirol will charge a fee of 200 € and the rental contract for tourist purposes will expire immediately. There is no right of refund for unused nights.
Quiet hours
Between 10 p.m. and 7 a.m. and between 1 p.m. and 3 p.m. the guests have to pay attention to room noise and have to behave in front of the house as well as in the staircase and in the apartment in such a way that the neighbors are not disturbed. In case of violation of this rule, we will charge a fee of 200 € and the rental contract for tourist purposes will end immediately. There is no right of refund for unused nights.
Luggage and valuables
We draw your attention to the fact that we cannot assume any liability for luggage and valuables. It is the guest's responsibility to lock the accommodation when leaving.
Parking facilities
Insofar as the guest is provided with a parking space in the yard or garage, this does not constitute a custody agreement. Fewo Service Südtirol assumes no liability for loss or damage to parked or maneuvered motor vehicles and their contents. The same applies to parked bicycles.
Pets
Pets are only allowed if this is expressly stated in the description of the accommodation. An additional cleaning fee will be charged for a pet.
Access to the accommodation
The employees of Fewo Service Südtirol are authorized to enter the booked accommodation at any time.
Damage Case
A damage case must be reported immediately to Fewo Service South Tyrol. For any damage or contamination to the accommodation, building, or inventory, the incurred damage must be reimbursed by the person responsible. The person responsible is liable for this in accordance with legal regulations (including accompanying persons and organizers). Theft and intentional property damage will be reported immediately to the authorities. Any damage claims from Fewo Service South Tyrol must be settled by the guest before departure.
Internet Usage
All accommodations have access to the internet via a wireless network (WLAN). The following agreements govern its use in the interest of all parties involved:
1. Permission for WLAN Internet Access
The owner of the internet access permits the guest to use the WLAN access to the internet during their stay. The shared usage is a complimentary service and can be revoked at any time. The guest does not have the right to allow third parties to use the WLAN.
2. Access Data
Usage is granted by entering a username and password. The access data (username and password) are intended solely for the guest's personal use and must not be shared with third parties under any circumstances. The guest undertakes to keep the access data confidential. The owner reserves the right to change the access data at any time.
3. Risks of WLAN Usage, Limitation of Liability
The guest is informed that the WLAN only provides internet access; virus protection and firewall are not available. The data traffic conducted via the WLAN is unencrypted. Therefore, data might be viewable by third parties. The owner explicitly points out that there is a risk that malicious software (e.g., viruses, trojans, worms, etc.) can enter the end device when using the WLAN. The usage of the WLAN is at the guest's own risk and responsibility. Fewo Service South Tyrol does not assume liability for damages to the guest's computer caused by the usage of the internet access.
4. Responsibility and Indemnification of Claims
The guest is responsible for the data transmitted via the WLAN, the incurred costs of paid services used, and any legal transactions conducted. If the guest visits paid websites or incurs obligations, they are responsible for the resulting costs. The guest is obliged to comply with the applicable law while using the WLAN. Specifically, the guest will not:
Use the WLAN to access or distribute morally or legally objectionable content.
Illegally duplicate, distribute, or provide access to copyrighted materials.
Observe the applicable youth protection regulations.
Send or distribute harassing, defamatory, or threatening content.
Use the WLAN for sending mass messages (spam) and/or other forms of prohibited advertising. The guest releases Fewo Service South Tyrol and the property owner from all damages and claims by third parties resulting from the guest's unlawful use of the WLAN and/or violation of this agreement. This also includes costs and expenses related to the enforcement or defense against such claims. If the guest becomes aware of or must recognize such a violation of rights and/or a violation of the agreement, they will inform Fewo Service South Tyrol about this circumstance.
Termination
In case of violations of any of the above rules, Fewo Service South Tyrol has the right to terminate the rental agreement for tourist purposes without notice. The guest's obligation to pay for the booked accommodations remains in effect.
Südtirol Alto Adige Guest Pass
Upon completion of the accommodation contract, the Südtirol Alto Adige Guest Pass (consequently Guest Pass) will be issued to the guest, which according to the decision of the South Tyrolean regional government No. 732/2022, is valid for the entire duration of their stay as well as from 0:00 on the day of arrival unto 24:00 on the day of departure.
The Guest Pass includes the use of all public transport within the “südtirolmobil” network area as well as additional services, which vary depending on the tourism organization. Detailed information can be found at: suedtirol-guestpass.info
The sole entity carrying the Guest Pass in South Tyrol is the Mobilitätskonsortium, appointed as the unified coordination point in accordance with the above decision of the South Tyrolean regional government by the Provincial Association of Tourism Organizations of South Tyrol on November 16, 2022.The details of the additional services associated with the Guest Pass and the conditions of use of the Guest Pass are communicated by the third party responsible for issuing and managing the Guest Pass. Privacy notice Südtirol Alto Adige Guest Pass
- Purpose
The personal data provided will be transmitted to the single coordinating body of the Guest Pass in order to enable the creation and use of the Guest Pass and to provide the associated services.
- Recipient
In connection with the issue of the Guest Pass, your data will be transmitted to the Mobilitätskonsortium, VAT Nr. 02735170215, which acts as the cardholder and unified coordinating body and assumes the role of autonomous data controller in processing the transferred data.
